Miller & Hightower is familiar with many of the Judges, prosecutors, and administrative staff in the Courts listed below. As such we have provided a few insights with regard to unique attributes regarding the operation of certain courts and disposition of some of the prosecutors with whom we work.

Judge: Kenneth O. Nix;

Judge Nix presides over the Austell Municipal Court, but also serves as a Superior Court Judge for Cobb County. We have found Judge Nix to be fair in his decisions in both courts.

Prosecutor: Leighanne McDougal:

The Solicitor position in the Austell Municipal Court has been historically filled by an Assistant Solicitor General from the Cobb County Solicitor General’s Office. We have worked with Ms. McDougal on several occasions achieving favorable results for our clients.

Judge: Timothy McCreary. Judge McCreary is a stern but fair judge. However, speeders beware. Judge Timothy McCreary has a strong dislike for speeders, and Judge McCreary will often harshly lecture violators on the perils of speeding. Judge McCreary will also structure a sentence for extreme violations that will be sure to get the attention of those found guilty of speeding.

Judge Neal Dettmering was appointed to the Douglas County State Court in 2001. Since that time Judge Dettmering has proven to be a very strict Judge with regard to procedural rules for his Courtroom. He is tough on “super-speeders,” requiring jail time for excessive speeds. When attending calendar call for trial in Judge Dettmering’s Court, one must be ready for trial or to negotiate a resolution with the prosecutor. Failure to be prepared for calendar call may result in the Judge refusing a negotiated plea in the future.

Judge Donald Howe. Hon. Donald Howe, Adjunct State Court Judge. Judge Howe is a seasoned Judge as he has served Douglas County as a Superior Court Judge for many years. As an Adjunct State Court Judge, he frequently presides in Douglas County State Court hearing motions, trials, and plea hearings.

Judge Joel Dodson. Hon. Joel Dodson, Adjunct State Court Judge. Judge Dodson a local Douglasville attorney was appointed as an adjunct Judge to assist with criminal plea hearings in the Douglas County State Court.

Prosecutors: The Solicitor General, Brian Fortner. Mr. Fortner was appointed by Governor Purdue in May 2007 to fill the unexpired term of former Solicitor General, Gregory Barton. Mr. Fortner is a seasoned prosecutor having prosecuted for several years in the Douglas County District Attorney’s Office. His Chief Deputy prosecutor, Evelyn Sandefeur, is a tenacious and experienced prosecutor who shows little mercy on DUI cases. Assistants, Katherine Iannuzzi, Mathew Krull, and Deah Warren.

Prosecutors: David McDade. The Douglas County District Attorney’s Office employs several experienced Assistant District Attorneys. Among those Assistants is  Jeff Billue, a Paulding County resident who has prosecuted in Douglas County for many years, Tom Whethers, a seasoned felony prosecutor who transferred from the Cobb County Circuit in 2008. In addition, the Office employs many younger and tenacious prosecutors who are well-prepared to fully prosecute any and all cases that come before them.

Judge: Hon. B. Keith Rollins. Judge Rollins was appointed by the Douglasville City Council to preside over cases arising from violations of State law occurring within the Douglasville City limits and violations of City ordinances within its jurisdiction.

Prosecutor: Lois Gerstenberger. Ms. Gerstenberger is a former Superior Court Prosecutor who is now in private practice in Douglas County. The Douglasville City Council contracted with Ms. Gerstenberger in 2009 to represent the City in its prosecution of misdemeanor and ordinance cases. Although Ms. Gerstenberger is a tough and experienced prosecutor she is fair in her assessment and prosecution of the City’s misdemeanor cases.

Jury trials are not available in Douglasville Municipal Court, as such, a jury trial can be requested and cases in Georgia municipal courts can be bound up to the County Superior Court or County State Court if available. However, often times M&H attorneys attempt to resolve Douglasville cases in the Municipal Court prior to requesting a jury trial.

Depending on the facts and circumstances surrounding the case, often times M&H attorneys attempt to resolve the case with the prosecutor in the Municipal Court prior to requesting a jury trial.

Judge: Honorable Scott Camp. Judge Camp was appointed by the Villa Rica City Council in 2007. Judge Camp has proven to be fair and reasonable when evaluating defendants and their offenses. While being fair and reasonable, Judge Camp can be hard handed with sentencing where the offense and the defendant’s behavior warrants harsh sentencing.

Prosecutor: Michael Hubbard. Mr. Hubbard is an experienced prosecutor who maintains a private practice in Douglasville, Georgia. Like Judge Camp, Mr. Hubbard is often fair and reasonable when the circumstances of the case warrant such approach. Additionally, Mr. Hubbard can creative in sentencing and attempts to tailor sentences to allow offenders the opportunity to learn from their mistakes and resolve their offenses in reasonable manner. However, Mr. Hubbard can be quite tenacious and stern in light of certain offenses.
